Terms of service

1sted.lol is a trading-card game about real software products, run by Akari Corporation ("we"). The Base Set has 102 numbered chairs. A founder proves they control a product's domain, attaches verified revenue, and pays to sit on a chair; the card that results is a public page and image about that product, scored and tiered by the rules.

A card is a record and a game piece. It is not a security, a token, an investment, a certificate of anything, or a claim on us or on the product it describes.

You must be at least 18 and able to enter a contract where you live.

You may only mint a card for a product you own or are authorised to represent, and only attach payment and analytics accounts that belong to that product. Minting someone else's product, or with someone else's numbers, is a breach and the card is removed without refund.

You sign in by email link or Google. Keep your inbox and Google account secure: anything done from your session counts as done by you. One person may hold several cards; one product may hold at most one chair.

A card belongs to the account that minted it. It is not transferable: it cannot be sold, traded, gifted or moved to another account, and we do not run or recognise any market in cards. A chair changing hands through a take is a game mechanic, not a transfer of a card.

The score, tier and figures on a card come from the snapshot and the published formula. They can move when the snapshot is refreshed. The number on the chair never moves while you hold it.

The finish is rolled once at mint, by chance, at the published odds. You are not buying a particular finish or tier.

Payments are taken by Stripe, which acts as merchant of record and handles tax. Prices are in US dollars: an empty chair costs $29; a take costs the current hold plus $10; a reclaim costs the gap; a raise is whatever you add.

Bids are final. Every completed payment is a bid on a chair and is not refunded — not if you are later taken, cut, out-bid, if the product changes, if the set locks, or if you change your mind. The single exception is a payment that could not become a bid because the webhook order gave the chair to someone else first; that one is reversed automatically. Stripe's fees on completed payments are never returned. Full detail is in the rules, §2.

A Checkout you abandon, a hold that expires before payment, or a payment Stripe never confirms is not a bid, takes no chair, and needs no refund.

Before the set is full, chairs are minted in order at the flat price. Once it is full, any product with a proven domain can take a held chair by paying its hold plus the step; the sitter has 24 hours to pay the difference and stay, or is cut. A cut product loses the number and keeps nothing on it except the public record on /cut. It may buy again.

At the published lock time the set freezes: the 102 products on chairs are 1st Edition, no takes or raises are possible afterwards, and nothing paid up to then is settled, returned or redistributed. We will not move the lock time once it is published.

The point of the set is that the numbers are real. You promise that the domain proof, the payment account and the analytics account you attach are the product's own, and that you have the right to let us read them. Figures are processed volume as reported by the provider, never profit, and we present them as such.

If we find a card was minted with a forged proof, a borrowed account, manipulated charges or other false data, we may re-score it, mark it, remove it, or cut it from its chair — at our judgement, without refund, and we may say why publicly.

Do not:

• attack, scrape at volume, or interfere with the site, the checkout, or other founders' sessions;
• coordinate takes and reclaims between accounts you control to game a chair;
• use a product name, logo or ability line that is unlawful, misleading or someone else's;
• resell, tokenise or represent a card as something it is not.

You keep every right to your product's name, logo and description. By minting you give us a worldwide, royalty-free licence to show them on the card, the board, the card images, link previews and our own promotion of the set, for as long as the card exists and, for the frozen set, afterwards as a historical record.

The site, the card designs, the formula and the set as a whole are ours. You may share and embed your card's page and images freely; you may not copy the site or issue cards of your own under the 1sted name.

The service is provided as is and as available. We do not promise uptime, that a provider's API will keep answering, that a snapshot is complete, that a card will keep its tier, or that the set will reach 102. The game is small and run by a small team; things may break, and when they do we fix them and say so.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, lost data or lost reputation arising from the service, and our total liability to you for anything connected to it is capped at the amount you paid us in the twelve months before the claim. Nothing here limits liability that cannot be limited by law, including for fraud.

You can stop using the service at any time and ask us to delete your account (see the privacy policy); a minted card's public record may remain with the personal fields removed. We can suspend or close an account that breaks these terms. Bids already made stay final either way.

These terms are governed by the laws of Italy. If you are a consumer in the EU you also keep the protections of the law where you live, and may use the EU online dispute resolution platform. Anything not resolved by talking to us goes to the courts of Italy, except where the law gives you the right to sue at home.

We may change these terms; the date at the top changes with them, and the text is versioned with the site's code. Changes that matter are announced on the site before they apply. Continuing to use the service after that means you accept them. Bids made under earlier terms stay final.
